I have a business in Delhi. An enforcement survey was conducted on my premises on 12-June-2013 and a deposit of Rs 15 lac was taken voluntarily from me dated 1-July-13. Later I filed objections to the charges levied against me and produced documents to prove them false. Subsequently I received a notice of assessment of penalty setting aside all the charges and levying a final penalty of Rs 4 Lac. It mentions that it can be adjusted from the amount deposited and the remaining amount to be refunded or adjusted as future tax credit. Now, this order was passed on 23-Sep-15. Till now , the department has not refunded any amount nor adjusted the same against my VAT liabilities. Futher, when I went to speak to the VATO, he said it is not a valid refund order and I will need to submit documents for the three assessment years (which were already assessed) again and then my refund order will be granted. Please advice on what is the procedure in this case . What is a valid refund order after an assessment. Are they only trying to get me to bribe them in order to process my refund. Help
