We are a registered housing society. Our Society was formed in the year 1991 without the co-operation from the builder. So far, the builder has not conveyed the property in favour of the society inspite of regular followup both in oral and in writing but, the builder is avoiding to execute a deed of conveyance on one pretext or the other. One of the partner of the builder is a practicing Solicitor in Mumbai and have been taking advantage of the same. We would like to file a FIR with the police for non-compliance of the obligations cast upon the builder under the MOFA.
My question is whether we can file a police complaint against the errant builder and its partners for not executing a deed of conveyance in favour of the society.
Kindly enlighten us on this point with your valuable guidance and advise.
