Our family is fighting my builder-managing committee nexus who are cheating the members of our society by not developing the garden and eyeing it for commercial use. The authorities are also bribed as the builder, HDIL is a very influential and notorious scamster. There also `appears` the involvement of political element like Mr. Sunil Prabhu, the Mayor of Mumbai.
Since we stood up for the truth, our names were erased with whitener and we were declared as non-members despite having paid share capital, entrance fees, society formation & registration charges etc to the builder upfront at the time of flat purchase. In fact, we were promoter members and the society was formed using funds that we also contributed to.
Copies of this erased list were submitted in co-operative court and the co-operative court held that we were non members and therefore it had no jurisdiction. We then approached City Civil Court and there copies of the list before the names were erased (i.e with our names on it) were submitted. We pointed out the difference but Civil Judge Mr. HANGE did not take action despite the conclusive evidence and orally asked us to file complaint before the Magistrate.
Having no respite from the authorities like Police, BMC & Co-operative Registrar. We filed a case of forgery and perjury before the Magistrate 67th Court, Mr. Jagdale, submitting both the documents as evidence. After arguments, since 02-May-2014, the matter has been kept for orders but the Magistrate kept us waiting all day and then at the end of day used to give another date even though there was enough time.
He used to just look at the case and keep it aside, then one day the Magistrate, told that it looks like there is no Criminal case but this is a Civil matter. Then another day he told to get some more evidence and then he kept the matter for re-argument. Usually if a prima facie case is made out, after examining the complainant and witnesses on oath, process is issued and the trial begins only after that.
However, in this case the Magistrate is dragging his feet and orally stating that this appears to be a civil case even though certified copies of both the erased and original document, as submitted in the two courts, is submitted on record and is conclusive evidence of the forgery and perjury.
It appears from the conduct of the Magistrate that he has been influenced by the Opponents.
