Bribe, like consensual sex, is a secret act between two parties; where one of the parties is under duress. Since accepting a bribe is illegal, how can this crime be proved in a court of law in the absence of any witnesses or proof ? Does the burden of proof lie squarely with the person asked to give bribe or does the court consider circumstantial evidence like undue delay in processing a file or clearing a valid claim etc ?
