Our Society had received revised property tax bills wef 2010 as…

Reported on July 30, 2014 from Mumbai , Maharashtra  ι Report #42270

Our Society had received revised property tax bills wef 2010 as taxing was revised to Capital Value based assessment. There were different parameters applied for correct assessment. We were assessed wrongly due to a data entry error wrt to location of the Society. As this was pointed out to the BMC assessment dept. they reassessed our property and sent correct revised bills.

Our Society Managing Committee, who had planned to encash the opportunity, tricked/convinced the General Body that they save Rs.40/45 Lakhs, for which the MC was required to "Bribe" the BMC officials, got released Rs.8.00 Lakhs, through 3rd party accounts (as Society is not authorized to draw the huge sum of rs.8-00 lakhs) paid Rs.7,20000-00 as if settled for Rs.720000-00 after deducting Rs.80,000-00 as TDS. (Accounted as consultancy fee/Liaison Charges).
Action from my side: 1. Wrote to Society MC asking to return the Money to Society Account.
2. Wrote to Grievance Cell/Advisory Committee of the society who failed to
convince the MC & got back to me with a comment that I may take
suitable action in this regard against the MC.
3. Registered a Complaint with the AMC, K/east Ward, Mumbai for necessary investigation and action. I am informed that their officers have done their job on their "official Capacity" within the parameters of the give guidelines and nothing out of the way. Also informed that I am free to take any legal action against the MC. They have not denied or accepted the offer of bribe by the Society. Society wrote to BMC that Rs.8.00 Lakhs drawn from Society a/c was for Consultancy towards Stopping road widening, RTI exercises, Deemed Conveyance etc. I have not pursued the matter further with BMC.
4. Complaint lodged with Dy. Registrar of Co-op. societies.
Correspondence is on with the Dy. Registrar of Societies.
5. I have lodged my complaint with the ACB -Mumbai - Complaint No.RI/1290 - in February 2014. Action is awaited.

Our Society Management, in all their defending reply to BMC, Registrar etc. maintains that Mr. Joseph Tharakan has a long record of disputes with society Management etc.
