History of my case
Sub : Some necessary points.
Respected Sir,
I would like to seek your permission to submit the following points for your perusal.

-1- About my appointment ……..
I worked in S. B. Vakil English Medium School Cambay in Kheda District as per Primary Government scale from 15/6/1978 to May 1982.I enclose the appointment order dated,15/6/78
After several correspondence with the Secretary sir of ********** Kelvani Mandal, Kodinar, I was given a letter by the secretary to resign the job of Cambay and to Take charge of their Mandal’s school in Kodinar as its Principal., with a temporary pay of Rs. 1000/-and with a promise of a government scale. I enclose all the letters of my correspondence with the Secretary Sir before my appointment in the school.
I gave my joining report to the S. K. M English Medium School Secretary to join the school dated 25/5/1982 but joined on 27/5/1982.
-2- About my government scale as promised by the Trust.
After my request to the secretary of the school to keep the promise of giving me the Government scale as per the order, the secretary informed in his letter that instead of Rs.1000/- I shall be given Rs.1275/-per month from 1st July ’84,as advance increment.
Again on 28/8/85 I requested to fix my salary and to give my due increment. As the school
wanted to take the permission from the government to start the primary classes 4- 5- 6- and 7, the secretary of the school called a meeting of the trust and in the trust resolution book of 1985-86 dated 11/12/1985 on page No: 3 it is mentioned that all the qualified teachers are given government scale signed by the trustees of the ********** Kelvani Mandal Kodinar. The above matter was informed and given in writing to the competent authority to get permission to start the above mentioned primary classes. And then, we all the qualified teachers were given the pay scale of a secondary school teacher. We all the teachers were given the secondary school pay scale from December 1985 to October1987.From November ’87 onwards everyone’s salary became consolidated and fixed. Today there are teachers in this school who just get less thanRs.6000/-even though they are working continuously for the last 27 years.
Whenever I asked for an experience certificate from the secretary regarding my salary, my work load in the school etc he gave to me without any hesitation, on the contrary he was happy to give me as he is pleased with my work. He even used to send his grandson to me to train and coach him even when I am not in the school, by saying that there are not good and able teachers now in the school to teach his grandson.
MY SALARY MENTIONED IN THE CERTIFICATES IS OF SECONDARY SCHOOL TEACHERS PAY SCALE. In my Appointment order the pay scale mentioned is 640+DA+ other allowances instead of 650+DA+ other allowances. It is by mistake. But in the Pay Bill and in the entire certificate; it is as 650+DA+ other allowances.
Worked and managed the secondary school also from the year June ’87 to July’ 88.I was not given any extra amount for it. I had done the work of two full time teachers plus office work from early morning till late in the evening. Even after the school hours I used to conduct extra classes in remote villages of Kodinar with the help of my dedicated sincere teachers to bring awareness to the parents about the teaching of English and its importance. For this we were not given single paisa from the trust. IT IS MENTIONED IN THE CERTIFICATES GIVEN TO ME, TIME TO TIME BY THE SCHOOL SECTERARY.
Repeatedly I used to request and send reminders to the school management to give the arrears of differences of salary and the government Pay Scale, instead of providing me the salary and pay scale the school management then appointed a new man in the school as Principal ********** Administrator above me to see my activities and to bring me down mentally, physically and physiologically. He was given extra allowances, free accommodation besides his regular salary. Just see the injustice they have done to me. Later the D.E.O Amerli appointed him as the principal of the Secondary section of the school. But the school management kept him as the Administrator with extra salary to take care of the Primary section in the afternoon shift and to look after the teaching requirements of students and teachers etc. Even a single day the new appointed administrator did not visited the afternoon shift as well as he was unable to arrange even a common meeting of two shift teachers. His motive/work was to give me unwanted notice to trouble me so that I may resign and leave the school.
-3- About my Termination and my appeal in the Primary Tribunal..
In my speech on 26th January 1989, I said fixing Colorful flags on the top of the school building and at the gate and giving different shades of painting to the building of the school alone will not develop the standard of any school further I told the requirement of teachers and students for the development of the school. The school did not appreciate my speech and I was terminated for misconduct from my service with out giving me any notice, dated 31/1/1989
With the advice of ********** Nanavati(Advocate) I challenged my Termination Order of the school in the Primary Tribunal, on 29/9/89 I got the verdict in my favour. It was a very clear cut verdict. The Hon'ble ********** did not refer my matter to the D.E.O to take a final decision. As I was not reinstated to my post as per the order of the Hon’ble Tribunal, I filed the contempt petition in the High Court, Ahmedabad.
The School management filed a petition in the High Court against the order of the Primary Tribunal dated 29/9/89 and later withdrew it, with permission for inquiry against me in accordance with law.
Pursuant to order of the Primary Tribunal and of the High Court of Gujarat Ahmadabad I was reinstated back to my post and position.
As the management promised to give me increment and proper salary dated 9/4/91, I requested my Advocate to withdraw the petition of the Contempt from the High court, Ahmedabad. After the withdrawal of the contempt the secretary accepted few letters of my request for increment and proper salary as per Government scale. Here I realized my mistake of withdrawing the petition of contempt from the High court. The school made me believes and cheated me.
-4- About show-cause notice…..
After the reinstatement the Secondary school Principal ********** Administrator was sending me unwanted letters to pressurize me so that I may resign from my post. The entire charge of the Primary School was given to him.
The school gave me show-cause notice dated 25/2/93. My immediate reply was given on 5/3/93. Additional reply was given with the advice of my Advocate dated 15/3/93.
Charge Sheet was given to me on 7/4/93. I gave an immediate reply on 10/4/93. I also gave an additional reply dated 16/4/93.
The School management gave me the office order of suspension dated 7/4/93 to conduct Departmental enquiry to enquire into my charges of misconduct etc as mentioned in the charge-sheet dated 7/4/93.
Letters and correspondence with R.A. ********** regarding my Departmental Enquiry with my representative with two sitting in the school itself dated 15th&16th May ’93
I informed to the District Education Officer Primary section Amreli about my suspension from the school dated5/5/93and also dated20/5/93. The D.E.O accepted my complain and called me and the school management for an enquiry I Amreli at 12.30 noon on 17/6/93.Due to some reason it was postponed and kept the same on 29/5/93.The educational Department cancelled my suspension of 7/4/93.The D.E.O clearly pointed out that the reason of my suspension was because I had asked salary as per the appointment order given to and also due to prejudice.
With the help of Advocate ********** Nanavati I filed a petition in the Primary Tribunal against the order of suspension. On 13/8/93 The Primary Tribunal cancelled my suspension which I got it on 27/8/93.
Report of R. A. ********** and Mrs.Solomens, Combined repot and also of my representatives was given to me. Mrs. Solomon does not even know a word to write in Gujarati signed the report blindly prepared by Advocate R.A. **********. She was made the representative of the school. She worked under my guidance when I was the Principal of the school. In the D.E.Officer’s chamber the same subject matter of suspension was inquired with me and with the school management. I showed all the proof to the D.E.O. to prove that I am innocent. But Advocate R.A.********** did not consider my proof to show my innocence.
-5- Second Show cause notice and Termination……..
I was given a second show cause notice dated 7/8/93. I gave two replies dated 8/8/93 and 27/8/93.
The school management terminated me from service in spite of three favorable verdicts including of my representatives. salary My representatives and the D.E.O’s verdict is quite similar and matching, both of them said the suspension was due to the demand of proper salary asked to the trust and they both also pointed out that due to prejudice I was suspended from the school..

Without any notice, the secretary’s letter informed me on 23/10/93 that I am relieved from service as punishment from my post as principal and from the school with immediate effect..The same I informed the D.E.O Amreli (Primary section).
-6- About the Primary Tribunal’s Court Order by the most Hon’able **********……….dated 22/06/2009
My advocate asked me in the second week of September ’10 to enquire with the D.E.O if they got any Darkhast against me in the D.E. Office from the school management. And when I asked for the result of the case he told me that I shall get it soon.
The D.E.O after many days of try and at last with the help of a third person I got the information that on 12/5/10 the school management put up a Darkhast against me in the primary Education Office Junagadh.
As I did not get the order of the Hon’able Court I went to Ahmeadbad dated 4/10/10 to my Advocate’s office, Advocate ********** ********** Gave me a copy of the Court order of 22/06/09. Advocate ********** Nanavati I met him in the Primary Tribunal but he did not talk to me the way he should. He did not give me his face to me to talk to……even though he was free then. His Assistant Advocate ********** ********** told me to go the school with the order and ask the secretary of the school to reinstate me back to my post in the school. With the t behavior of my Advocate I felt I am cheated.
Immediately after I got the order I did the correspondence with school management and to several officers of the state for considering my case for help. I here in attach all the correspondence I did after I got the Court order 4/10/10.
The Secretary of the school did not respond to any of my letters but when I send him a copy of the letter to the Chief Minister and other officers of the state he immediately gave me a reply that as he is busy and he would answer me on 24/12/10. After the given date I reminded him about his promise to answer me…… but no reply.

While concluding, please help me I need your valuable advice to fight the injustice done to me .Please go through all the enclosed documents of my case and advice me accordingly to get justice.
(The Hon’ble Tribunal,Ahmedabad has not send me the Tribunal’s Order by post till date.)
