Charitable organizations situated in India are required under the Act to obtain FCRA number to receive donations from foreign donors. Donations so received from the foreign agency / individuals from abroad are subject to income tax assessment by income tax authorities. In the instant case, if the institution receiving contribution from a foreign individual does not have FCRA number and has not been filing income tax returns on a regular basis, income tax authorities have jurisdiction over such transactions and are legally empowered to impose fine if the amounts so received are not tax exempt.”
