I\'ve to help my mother register her villa in Sarjapura village in Anekar Taluk. I was asked to pay Rs.30000 in cash by the builder inclusive of property tax and Khata certificate without any receipt

First, let me apologise for the delayed reply. I have been answering questions relating to land in a piecemeal manner and then took some time off to understand the process fully, before offering advice. I spent the last two weeks consulting various experts, including honest people who have worked in the BBMP and those who are working in the BBMP.</div>

Most cities in the country are growing rapidly and Bangalore is probably the fastest amongst them. Since land values are very high in the city, many commercial property developers have been developing housing and apartment complexes on the periphery of the city. The lands on which these are developed are located mostly in the areas of Gram Panchayats. Now, Gram Panchayats are governed by the Karnataka Panchayat Raj Act, and it is under this act that they give the building licences to construct. But this law in not designed to consider instances of construction of such large and complex layouts. it is more for the purpose of handling the construction of farmhouses and smaller individual houses. But since there is a time lag between the actual process of urbanisation and the formal process of including such built up areas into the BBMP, Gram Panchayats have had to cope with the task of giving licences to these builders to construct complexes. I presume your mother is buying a villa in such a place.</div>

The first thing you will require to do, is to find out whether the &nbsp;villa is in a Gram Panchayat area, or is in an area that has been integrated into BBMP. The procedure is different in these cases.</div>

Presuming that the villa is not in the BBMP area, you will next &nbsp;need to check whether the land on which it has been built has been converted from agricultural to non agricultural purpose. If it has not, be careful, because you cannot get a Khata from the Panchayat. But if the land has been converted, then please find out whether a Khata has been assigned to it by the Village Panchayat.</div>

Please tell the builder clearly that you will not pay a bribe. It is best to clear the picture straightaway. Then tell him that you know the law and you will insist that things go according to the law. Also tell him that he is duty bound to make documentation available to you. &nbsp;The following documents are to be given to you by the Builder:</div>

Title documents, flow chart of the title [ The developer has to give these details. Normally it should form part of the sale deed itself.]</li>
<li>
Copies of previous tax paid receipts,</li>
<li>
Order of conversion of land from agricultural to non agricultural purpose</li>

Proof of improvement charges paid, if any,</li>
<li>
Khatha extract issued by the erstwhile Panchayat ( The developer has to give this copy.)</li>
<li>
A Sketch showing the location and measurements of the property ( the builder has to give a certified measurement)</li>

Once you get these documents, you can yourself apply to the Village Panchayat for the transfer of the Khata of the property to your name enclosing all the documents, including the registered sale deed. Again, do not pay a bribe.</div>
