Reported on April 16, 2013 from New Delhi , Delhi  ι Report #34354

I am an Ex Indian Army War Wounded Officer from the Cavalary. After having served for 10 years in the Armd Forced and having been wounded in Indian Peace Keeping Forces in Sri Lanka, I hung my boots in 1994 being a Short Service commissioned Officer.

I ventured into Tourism business in 1994. The incident is of 2002, 28th December at Vasant Vihar Parking Lot opposite Sugar and Spice. Where in my Car wagon R HR 26 N 0849 being driven by my Nephew and his brother in law, was damaged by parking boy. The door worth Rs. 22,000/- was completely smashed. When my Nephew asked him for the damages and requested him to accompany them to the workshop for actual assesment the owner of the Parking Lot a complaint of Kidnap. since the Vehicle belonged to me, an Inspector Mr Pratap Singh of Vasant Vihar Police Station in his own wisdom registered an FIR and charged me under section 365 and 364 of IPC. (HO0LDING THE STATE FOR RANSOM). Since, it was a case of mistaken identity the inspector took a bribe of Rs. 7000/- from us for not to oppose the bail application.

But this whole episode caused a damage of more than Rs. 1 Crore in cash and kind. Loss of business reputation and 10 years of litigation. It was only on 10th July, that we were acquitted by the Court due to Police not being able to produce the complainant.

It is absolutely ridiculous that a Sub Inspector, who has no knowledge of Law can charge any one without proper or thorough investigation and not assuring that complainant is also made available for Cross Examination. The state can not wash their hands off just by acquitting the accused due to lack of witness or complainant not traceable. The process of law is long but it is not soft.

Justice delayed is Justice denied.

Why the IO can not being made answerable for every investigations that he makes, records and file a charge sheet?

Why the state should not pay me damages for ruining 10 years of my professional profile???. I am seeking a public opinion through this platform.
MY CBIL HAS GONE BAD. WITHIN THREE DAYS 28THE DECEMBER, 2002 TO 30TH DECEMBER, 2002 MY BUSINESS BASED AT HOTEL 32ND MILESTONE, CRASHED. I WAS THE OWNER OF 7 COMMERCIAL VEHICLES, WHICH WERE ILLEGALLY REPOSSED BY THE BANK`S MUSCLEMEN.

IT TOOK ME 10 YEARS TO REBUILD THE BUSINESS.
