Un-necessary paid customs duty

When coming form abroad, i had purchased a LCD TV and we were 2 traveling together.
The customs rule says that the duty will be levied on products exceeding Rs 25,000, if the product is new and if not for personal use. Here the TV was old (6 months), with stains and it was my personal TV, since i was re-locating to India. The customs officer was not ready to listen to me and charged me a customs duty of Rs 7500.
