We have received a re-assessment notice under section 9(2) of CST act from Asstt Comm. Audit 1.4 DVO-I Yeshwantpur Bangalore for FY 2007-08, demanding differential tax, penalty and interest on an interstate transaction. We have already submitted the C Forms in Original to the concerned LVO and the CTO has given an acknowledgement of having received the relevant C Forms.
We wrote these facts and our objections, enclosing copies of previous assessment order and CTO's acknowledgement of receipt of relavant C Forms to the concerned Asstt. Comm. and attempted to submit it through our CA's staff. However, he has refused to accept/acknowledge our letter and verbally demanded that we submit to him all books of accounts, documents, etc for re-assessment.
Our CA has suggested that he be paid Rs. 5,000/- as bribe to settle the issue and that either we pay him or escalate the matter to Commissioner level. I would appreciate to have the following information.
a. Can the Asstt Comm refuse to accept/acknowledge our written objections and demand a re-assessment. b. Will it be fruitful to escalate the matter to Commissioner level, as we presume the AC and Comm may be hand in glove.
