Hi,
I had purchased an apartment in 2003 and the place was under CMC. At later point in time CMCs were merged and BBMP was created. Now I am looking to sell the apartment but the buyer is asking for Occupancy certificate or Completion certificate.
I came to understand that "issue of Occupancy Certificate by the BBMP on completion of construction is a mandatory requirement under the City of Bangalore Municipal Corporation Building Bye-law 2003."
So it appears that when I bought the apartment in 2003, the OC bye-law was not in force and even if it was my area came under CMC and was not applicable.
Now the builder has no commercial interests in the property and not willing to get an OC.
These are few of areas I am unclear -
1. Is Occupancy Certificate and Completion Certificate serve same purpose?
2. Is it mandatory to get OC/CC now for this flat?
3. If it is, then since builder has no commercial interests and is unwilling, can I approach BBMP to get CC/OC?
4. Heard that there are people who assess apartment and give 'valuation certificate'. Is it possible?
Appreciate any help, or even if you could point me to the place where information is available.
