Hi my name is Shruti Sawant (Maiden name). I got married at the Margao sub registrar in Dec 2012. The lady who did the paper work forced me to change my name to my husbands surname , she said "as per Hindu Marriage Act , I have to change my name to (Shruti Jayesh Halarnekar)" even though my husband and I were not willing to change it,We also did'nt want to argue with her as the registration was at 3:30 and our bus to Bangalore was at 5:30 . At that time we asked her if we could change it back to my maiden name and she said "yes". So we went ahead and signed on the certificate as we had to presume work the next day in Bangalore.
After few months we went to the Margao sub registrar to change my name back to my maiden name and we were told that it was not possible.Since than every time we went to Goa we went to the sub registrar to request them to change my name . We also spoke to the civil registrar Mr. Suraj R Vernekar to find a solution , well he suggested we get a divorce to change the name. So we went to a lawyer and got a joint affidavit made to change my name, but he refused to accept it. Now I am holding a Portuguese passport in my maiden name acquired in 2014 and I'm residing in the UK. My husband is in India and his Indian passport is expiring and when he went for renewal they want a Form D which has to be signed by both my husband and me , but I'm unable to come back to India to sign on the affidavit as my Visa has run out and I'm unable to get a leave from work as I've just started work. Kindly advise how I can go about with reverting my name to my maiden name on the marriage certificate as I have not used my husbands surname on any official documents except the marriage certificate and also because I do not wish to use his last name. Please also suggest what other process can be followed to add my maiden name on my husbands passport.
